I wanted to talk today a little bit about a very interesting case that was filed against the manufacturers of Xarelto that is Bayer Corporation and Janssen Pharmaceuticals in the state of Illinois by a woman who’s filed a 90 count complaint against the manufacturers of that drug.
What are alligations in this lawsuit?
The plaintiff in that Illinois lawsuit has filed her complaint and one of the allegations is that the manufacturers of Xarelto, that is Bayer Corporation and Janssen Pharmaceuticals, really emphasize the positive aspects of the clinical trials during the course of the FDA approval process. They failed or they did not pay very much attention or give very much weight to the negative aspects of the clinical trials which in fact showed significant bleeding in many of the patients.
Marketing failed to mention the risk of taking Xarelto during marketing
In marketing Xarelto, in fact, the defendants that is Bayer Corporation, Janssen Pharmaceuticals, emphasized the positive things that came out from the FDA clinical trials. They failed to mention in most instances in their marketing materials, the adverse effects of Xarelto such as the uncontrollable bleeding.
Xarelto made a profit of over $600 million
One final point of note or which is noteworthy in this litigation is that when Xarelto was marketed initially in 2011, that almost $11 million was spent in the marketing efforts of Xarelto and during the same year approximately $600 million was paid or I should say not paid but made by Janssen Pharmaceuticals and Bayer Corporation from the marketing of this particular drug.
