I’m Roger Ghai and let’s talk today about depositions. A deposition is basically where you are giving your testimony before a court reporter under oath. The other party is asking questions about the facts and circumstances of your case. There are certain things that you should not do during your deposition. Number one, you should not volunteer any information. Number two, you should go ahead and listen to the question that the lawyer is asking.
The last thing that you want to do is not understand the lawyer’s question so you should go ahead and if you need to ask for clarification from the lawyer as to what he or she is asking.
What if I don’t understand the question being asked?
If you don’t understand a question that the lawyer is asking you during the deposition, make sure that you ask for clarification. The last thing that you want to do is answer a question which you really didn’t understand.
The reason you don’t want to do that is very simple, the lawyer is going to go ahead and use that testimony, whatever that testimony is that you give during that deposition later on against you in court.
What if my lawyer objects the other lawyers question?
If your lawyer has stated an objection to one of the other lawyer’s questions, make sure that you stop answering any questions until your lawyer has clarified the objection.
