The truck driver’s employment file has to contain the application and it also has to contain any responses that the trucking company received from the trucker’s prior employers. The file on the trucker should contain a copy of the driver’s license as well as a copy of the driver’s pre-employment driving record. The file should also contain any annual reviews by prior employers on this truck driver, as well as the medical records or medical examiner’s certification that the truck driver is actually physically qualified to drive.
If the particular trucker does not drive for the trucking company on a consistent basis, then the trucking company is not required to maintain a file on the driver, so long as the trucking company that does employ the trucker on a regular basis certifies in writing that the truck driver is qualified to drive. If, for whatever reason, the truck driver’s license is suspended or canceled, the truck driver must notify the trucking company within one day of such event.
If the truck driver was charged with a moving violation, then he or she is going to have a duty to notify the company of that event also. The surface board maintains a record of the licensing, suspension, disqualification of truck drivers.
