Usually, the general rule is that a broker cannot actually be held liable for any injuries caused in a truck accident because they normally are what we consider to be an independent broker. Furthermore, they are not usually the employer of the actual truck driver or the trucking company, hence for those reasons they normally cannot be held responsible for any injuries resulting from a truck accident.
However, in the instance where the broker can actually control the manner of work or the method of work or can actually discipline the driver of the motor carrier, then there are instances where the would be an exemption and the broker, in this case, could be held responsible for any damages resulting from any truck accident. Another indication of whether the broker could actually be held liable would be if the broker can actually discipline the truck driver for any maleficence on his or her part.
