Hi. I’m Roger Ghai and I wanted to talk today a little bit about whether you can or you should handle your own automobile accident case by yourself and resolve with the insurance company. I would say that in some instances it’s perfectly fine to do that. In fact, if you have $2,000 or less in property damage, you probably want to go ahead and try to resolve it with the insurance company by yourself. I say that because quite simply, the truth is that the insurance company is not going to pay you a whole bunch of money if you only have about $2,000 or less in property damage.
If you go ahead, and you hire a lawyer, and you only have that amount of property damage, there really is not going to be a lot left for you. Just be aware that if you handle your property damage or your car accident case and resolve it with the insurance company yourself that you’re going to be able to recover for your lost wages, your pain, and your suffering, your medical expenses, and other general damages.
If you do decide to handle your personal injury case yourself, you should be aware that there’s no formula that determines exactly what the value of your case is. It will depend on a variety of factors, such as your lost wages, the type of treatment that you saw, the medical expenses you’ve incurred. Those types of factors are going to come into play. You should be aware if you do file your own lawsuit against somebody for your car accident case, that you only have two years to file that lawsuit and serve him or her with the copy of the lawsuit. Make sure, too, please, that you serve the correct person.
