This is Roger Ghai and I wanted to talk today about whether an insurance company, that is an insurance company which ensures the motor carrier, can actually be held liable for any of your damages. The answer, believe it or not, is actually, “Yes,” an insurance company can in certain instances be held liable for damages caused by a truck driver. The reason for this is simple. Nowadays, more and more insurance companies have become more and more involved in the hiring of truck drivers for smaller insurance companies.
Many times, the smaller truck companies do not perform any background checks on its truck drivers, and instead they rely solely on the insurance company to perform that background check. For that reason, the responsibility then shifts for legal reasons and legal purposes to the insurance company as to whether they actually performed an adequate background check on the driver.
