This is Roger Ghai, and I’m an accident attorney who practices in Kennesaw and Acworth. I handle all the metro area, especially Cobb County. I’m going to talk today a little bit about a question that sometimes arises. There’s always a lot of highway construction going on and interstate 75 and the various roads throughout our county and in everything like that. The issue is this, what happens if it was a Georgia Department of Transportation defect in the road? Maybe they designed the road improperly that can cause an accident and sometimes it’ll even lead to death, injuries, fatalities, or maybe other serious injuries.
If you’ve got one of those types of cases, it’s important, really, that you go to a skilled lawyer because then it’s not the typical car crash case, where somebody rear-ended you or they failed to stop at a stop sign or anything like that. You’ve a more serious case if you’ve got serious injuries and a more complicated case because there are certain notices that actually have to be sent to the governmental agency.
There’s research that has to be done as whether there were accidents at that intersection or on that roadway or at that curve before, which would have put the state on notice that this was an accident-prone site. Not only that then the cases, like I said, are more complicated, experts actually have to be retained, which can get to be an expensive lengthy process. Tens of thousands of dollars sometimes, and so there will be a battle of the experts as to whether this road was constructed properly, or this intersection should have had another sign there or what-have-you.
