Hello, this is Roger Ghai, with Law Offices of Roger Guy. I practice bankruptcy law in Kennesaw and Marietta, and in the Atlanta Metro area. I wanted to speak this morning about being able to file for bankruptcy during these difficult times of the COVID-19 virus. Number one, just rest assured that an office visit is not necessarily required. If you think you need to file bankruptcy, if those are the circumstances that you find yourself in right now, one of the things that we can do is we can do a video telephone conference for the initial consultation, get the paperwork and do the initial intake, and gathering the information just as we would as if you were in the office. The other question that sometimes that we get from people is, well, what about going to the courthouse? Are the bankruptcy courts still open? Questions of that nature.
The cases are filed electronically, that is, regardless of whether there’s a virus or not, the bankruptcy petition itself has filed electronically. There is a hearing, which before the COVID-19 virus, you were required to attend in person at the hearing room in the bankruptcy court house. But because of the COVID-19 virus, the courts are now allowing telephonic hearings to occur. So that’s basically how that would work. So you don’t have to have a lot of human contact to either, number one, file the case, number two, to actually go to the hearing and get it processed cause the hearing can be done telephonically.
