Hi I’m Roger Ghai and I wanted to talk today a little bit about some of the additional questions that people have in car accident cases. One question is, “Should I talk to the insurance company by myself?” My answer is, absolutely not. If you’re talking to the insurance company, you do not want to talk about your injuries because they will twist your words and then will try to use anything that you say against you later on.
Should I take pictures of the car?
Another question that I often get is, “Should I take pictures of my vehicle after my accident?” My answer is, “If you can do it safely, please make sure to take any photos that you can of the accident, the vehicle damaged and the accident scene itself.
I am not at fault. Should I notify my insurance company of the accident?
Sometimes people also ask me whether they should notify their own insurance company even though they have not caused the accident. My answer is, yes you should and there are good legal reasons for you to do so.
What should I do if the insurance company won’t settle?
Sometimes people asking what they should do when the insurance company will not settle with them? Probably, you’re going to need to retain a lawyer at that point because the insurance company for one reason or another, has decided to fight you on the claim.
Is there a deadline for filing a personal injury case?
A question I also received frequently is, “How long do I have to file a lawsuit?” In Georgia, if we’re speaking about a car accident case, you have just two years to file the lawsuit and serve the defendant with the copy of the same.
What damages may I recover in my case?
Another popular question I receive oftentimes is, “How much in damages can I receive and what type of damages can I recover?” You’re entitled to recover your lost wages, your medical expenses, your pain and your suffering and some other general damages.
