Rehabilitation of truck drivers with regard to either the alcohol use or the illegal substances use, the trucking company actually has an affirmative duty to advise the trucker of different resources that are available to him or her to assist with the drug or alcohol issue. In fact, the driver is supposed to be evaluated by a substance abuse professional to determine what is the best course of action to treat the abuse.
Once the determination is made that the truck driver actually is in need of a substance abuse professional then the trucking company has an obligation to make sure that the drug testing professional or the abuse professional actually performs unannounced, random drug or alcohol tests on the driver. Of course, the driver has to actually complete the treatment program and the company should be evaluating whether the driver is actually complying with whatever the recommendations are of the abuse professional.
