I’m a little bit surprised because sometimes acquaintances and friends know what I do as far as medical malpractice cases and wrongful death cases, but nonetheless, they’ll still come up to me and ask me for a referral to a good car accident attorney. Let’s talk today a little bit of what a personal injury attorney actually is.
A personal injury attorney will handle a variety of claims. Those claims can be anything from a wrongful death, a slip and fall, medical malpractice. A boating accident, a motorcycle accident, aviation accident. Any type of accident where you or a loved one has been hurt or injured by somebody else’s carelessness. In the law, we call it negligence. Quite simply that’s what a personal injury attorney is or what a personal injury attorney does.
A personal injury attorney is not somebody who handles property damage claims. For example, if you’ve been involved in a car wreck, and the only damage that has been sustained has been to the vehicle and you were not personally hurt, then that’s what’s known as a property damage claim. Now, if you’ve been involved in a car wreck and both your vehicle has been damaged and you’ve been hurt physically from the car accident, then you have both a property damage claim which will usually be settled out by the other insurance company. Then you have a personal injury claim for which you sought medical treatment.
A wrongful death claim is simply a claim where someone has passed away as a result of someone else’s negligence or carelessness. In the state of Georgia, the wrongful death claims and the statute itself can be very complex to navigate through. You want to make sure that if you have to retain a lawyer on behalf of a deceased estate that you have a confident lawyer who is familiar with all of the wrongful death statutes and laws in the state of Georgia.
