Hi, I’m Roger Ghai and I wanted to talk today a little bit about how your medical bills get paid after you’ve been involved in an injury case. It could be a trucking accident case. It could be a medical malpractice case. It could be a car accident case. Exactly what is the obligation of the negligent party’s insurance company to pay your bills just after the accident or after the injury?
The answer is this, and you’re not going to like it, unfortunately, but the other insurance company has no obligation, whatsoever, to pay any of your medical bills until the case is fully and finally settled. The problem arises is this, you may be treating for two months, three months, six months, or even longer, and in the meantime, the medical provider, let’s say for example is Kennestone Hospital, they want to get paid or the urgent care wants to get paid immediately.
They don’t want to wait until your cases settled up. A lot of times if you’re working with a personal injury lawyer, the lawyer can contact the provider and make a promise to pay them when your case is settled. That’s one option. Sometimes insurance will come into play and then your insurance company will pay the bill in the meantime, but a lot of clients get very frustrated, and understandably so because they’re not the one that caused this accident. They’ve been injured.
It was caused by somebody else’s negligence and yet the client has required medical treatment and they may not have funds. You may not have funds to just shell out thousands of dollars for your medical care until the case is settled up.
